Estate Planning with Health Care Needs

Optimize Available Health Care Options While Minimizing Legal Concerns

The following are important factors to keep in mind in the event that an individual has health concerns with no plan in place, or if significant time has passed since implementing a plan for your family’s future.

  • Care Options Evaluation – Careful consideration is put into the health and care needs of the individual, family and the current insurance coverage.  An RN-Case Manager will focus on this throughout the planning process, while evaluating eligibility for community-based programs, and an assessment of financial criteria to maximize qualifying services at home.

  • Estate Planning and Living Documents** - Comprehensive Durable Powers of Attorneys and Health Care Proxies/Living Wills are essential when a loved one’s health is declining.  The individual is able to appoint a trusted friend or family member to make important decisions pertaining to their health, legal or financial matters in the event of incapacity.  Care needs and mortality are also taken into consideration when preparing Estate Planning documents.

  • Asset Preservation and Financial Guidance*** - To prepare for the likelihood the individual’s health will rapidly decline, requiring excessive care costs, an evaluation of current assets will be made.  A strategy will be devised to protect your assets from out-of-pocket care expenses and implemented in an Estate Plan.  This process will be done taking into consideration the next level, Medicaid Planning- see Emergency and Crisis Planning.
